We have sizeable experience representing employers at WCB hearings in an effort to reduce the ongoing costs of a WCB claim. We work with clients to reduce costs by consulting and making recommendations to reduce claims and by ferreting out fraudulent claims, sometimes with the aid of a private investigation team. We represent employers at both Workers' Compensation and WCAT tribunal hearings.
There are many new issues with which businesses have to concern themselves. Our Labour Departmentt is very skilled in developing seminars for our clients in the areas of the Interpretation of Collective Agreements, Management, Wrongful Dismissal, Discipline and Discharge, Sexual Harassment in the Workplace and countless other topics.
Often, deaths occur at a workplace site and must be the subject of an official inquest which seeks to make recommendations to ensure that such incidents do not occur again. We represent employers at such inquests which are quasi-judicial hearings and often issues arise under The Occupational Health and Safety Act of Ontario.
The law of accommodation under The Human Rights Code of Ontario and other statutes requires an employer to accommodate individuals with a disability to the point of "undue hardship". The law in Ontario and other jurisdictions is continually evolving in this area. We assist employers in interpreting, understanding and adjusting to new workplace realities.
Various professional bodies - - dentists, lawyers, nurses, chiropractors, doctors, optometrists, etc - - are becoming more viligant with respect to regulation of their members. These same members must protect their rights and their ability to carry on their professions. We assist the members of these professions or the employers in handling a complaint that has been filed and in representing a member or organization before a tribunal hearing.
Employers and organizations often require instant knowledge as to whether a particular statute or situation has application. Our Labour Department is continually involved in the interpretation of statutes, both provincial and under the Canada Labour Code and other federal legislation, and renders advice to employers to allow them to meet the requirements of new and expanding jurisprudence.
Our Department keeps abreast of new issues, trends and legislation and continually researches the application of these areas upon existing situations.
